Nearest relative considers need to make application
The nearest relative should consider the criteria for application for detention. The person's "nearest relative" is defined in Article 32 and that person, if any, should be identified and advised of their right to make an application for the person's detention in hospital for assessment. The nearest relative must be advised that they do not have to make the application and that an ASW can be asked to do so or can provide advice and assistance in the situation.
What if the person has no nearest relative within the meaning of Article 32 of the Order?
In this event the approved social worker may proceed with the assessment and make an application if necessary.
